Overtime Policy (CA)
(effective March 2020)


This policy is a supplement to the Overtime Policy (US).  It applies to sites and Non-Exempt Associates in California.

 

Mars complies with applicable California laws regarding the payment of overtime wages.  Mars workweek starts on Sunday at 12:01 a.m. and runs through Saturday at 12:00 midnight. A workday is 24 consecutive hours starting at the same time each day and may vary by site or by shift.  Daily overtime is based on the number of hours worked in an applicable workday.

Overtime is paid when Non-Exempt Associates work more than 8 hours in a workday or more than 40 hours in a workweek. Non-Exempt Associates are required to accurately record their work time, including start and stop times, by clocking in and out properly.

Regular Schedule Overtime

Non-Exempt Associates who work a regular schedule are paid overtime pay as follows:

  • One and one-half times (1.5x) their regular rate of pay for any work:
    • Between 8 and 12 hours in one workday.
    • Over 40 hours in a workweek.
    • During the first 8 hours on the 7th consecutive day worked in a workweek.
  • Two times (2x) their regular rate of pay for any work:
    • Over 12 hours in one workday.
    • Over 8 hours on the 7th day worked in a workweek.

 

Alternative Workweek Schedule Overtime

Non-Exempt Associates who work an alternative workweek schedule are paid overtime pay as follows:

  • One and one-half times (1.5x) their regular rate of pay for any work:
    • Over the schedule established by the alternative workweek arrangement up to 12 hours in a workday.
    • Over 40 hours in a workweek.
    • Over 8 hours in a workday, if the company requires the employee to work fewer hours than those that are regularly scheduled by the alternative workweek arrangement.
  • Two times (2x) their regular rate of pay for any work:
    • Over 12 hours in one workday.
    • Over 8 hours on those days worked beyond the regularly scheduled number of workdays established by the alternative workweek arrangement.
